TACDL President Cynthia Orr Discusses the Fourth Amendment and Miranda Rights

Texas Association of Criminal Defense Lawyers President Cynthia Orr said search and seizure policies have been improving since the 1950s to provide for more security, but there still is work to be done to protect citizens.

In Voice for the Defense, a TACDL publication, Orr said people were questioned without having their rights read to them in the 1950s, before the Miranda Rights were instated. Now, people have more freedom and protection, but there still are issues. The U.S. Supreme Court is adamant about being in compliance with the warrant requirement, but there still are instances where innocent people become victimized by the government, Orr said.
