NACDL and The Heritage Foundation Release Report About Criminal Intent Requirement in Federal Law

According to a report released by the National Association of Criminal Defense Lawyers and The Heritage Foundation, many of the criminal offenses Congress is enacting are flawed. A majority of enacted offenses fail to protect the innocent with adequate mens rea, or "guilty mind" requirements, and many of them are vague, far-reaching and imprecise, leaving lawyers unable to determine what specific conduct they prohibit.
